Terms of service
Plain English wherever possible. If anything here is unclear, ask us before you buy.
Who we are
BAD APPLE DIGITAL is a trading name of Josh Willis, a sole trader based in the United Kingdom, providing music marketing services to artists, labels and creators. Business address: 67 New Lane, Southport, PR9 8LN, United Kingdom. Contact: hello@badapple.digital
What you are buying
A service, not a product and not an outcome. We agree to carry out the work described on the relevant product page, to a professional standard, within the timescales stated there.
What we do not promise
We do not guarantee any specific number of playlist placements, streams, followers, engagements or any other result. Where a product page gives typical figures, those describe what we usually see across comparable campaigns. They are not targets, forecasts or promises, and results vary with the music, the market and decisions made by third parties we do not control.
Your responsibilities
- You confirm you own or control the rights to the music and materials you give us, and that we may use them for the purposes of the service.
- You will provide accurate links and information. We are not responsible for work carried out against incorrect details you supplied.
- You remain responsible for your own artist profiles and for anything you publish.
Spotify services
Spotify Campaign and Spotify Monthly are pitching services. We approach independent curators on your behalf and they decide whether to add your music. We work from your public artist profile and do not require access to your Spotify account. We do not pay for placement, and we do not use bots or artificial streaming of any kind.
Social Growth
Social Growth operates engagement activity on your social media accounts on your behalf, which requires you to grant us access to those accounts at onboarding. By purchasing, you authorise that activity and confirm you have the right to do so.
The activity is carried out from real devices at a human pace and involves no fake accounts, purchased followers or purchased engagement. Social platforms nonetheless operate their own terms and their own automated enforcement systems, over which we have no control. You acknowledge that the operation of third party platform policies is outside our control and that we are not liable for any restriction, limitation or other action a platform takes in respect of your account. You may end the service at any time, after which activity stops.
You are responsible for the content you post. We do not create, schedule or publish content on your behalf.
Access and security
Where you grant us account access, we hold those credentials only for as long as the service runs, use them only to deliver the service you bought, and remove them when the service ends. You may revoke access at any time. Revoking access before a paid month has finished ends the service for that month and is not refundable.
Payment
All prices are in pounds sterling. BAD APPLE DIGITAL is not currently VAT registered, so no VAT is charged. One off campaigns are paid in advance. Monthly plans bill on the same date each month until cancelled.
Cancellation and refunds
Before pitching begins. Cancel any time before we start and you get everything back. That includes tracks booked ahead of release: if you call it off before release day, nothing has been spent and nothing is owed.
Once pitching has begun. Sales are final. Every campaign is built around one track, and the curators we approach are chosen for that track specifically, so the work and the cost both land at the start rather than spread across the four weeks. There is nothing sitting unspent to give back. We will still look properly at anything that has genuinely gone wrong, but a change of mind after pitching has started is not a refund.
The audit. Once the audit has been written and sent it cannot be refunded, because the work is the product. If you have not received it within five working days of ordering, tell us and we will either deliver it immediately or refund you.
Monthly plans. Cancel at any time from your account before your next billing date. Cancelling stops all future payments straight away. We do not refund the month you are already in, because that month's work has already started. No minimum term, no notice period, no retention call.
Your statutory cancellation rights. Buying as a consumer in the UK, you normally have 14 days to cancel a service bought online. Because campaigns begin within 24 hours, we ask you to confirm at onboarding that you want us to start straight away and that you understand you lose that right once the service has been fully performed. If you would rather keep the full 14 days, say so and we will hold your campaign until it ends.
If something goes wrong. Email hello@badapple.digital and we will put it right. We would rather fix it than argue about it.
Liability
Our total liability in connection with any service is limited to the amount you paid for that service. We do not exclude liability for death or personal injury caused by negligence, for fraud, or for anything else which cannot lawfully be excluded. Nothing here affects your statutory rights as a consumer.
Intellectual property
You keep all rights in your music and materials. BAD APPLE DIGITAL keeps all rights in our reports, audits, templates and methods. You may use anything we deliver to you for your own purposes but not resell it.
Changes
We may update these terms. The version in force is the one published when you place your order.
Governing law
The law of England and Wales, with the courts of England and Wales having jurisdiction.
